Nature of grievance

ARBITRATION BY A SURETY AGAINST THE PRINCIPAL DEBTOR: Where a person A becomes the guarantor for the debts of B and thereafter lawfully pays to the creditor, and where there exist any Arbitration Agreement between the Surety and the Principal debtor, Arbitration proceedings may be initiated by A for the recovery of said money against B, within 3 years (unless otherwise agreed) from the date when the debts were lawfully discharged by A, having regard to Article 42 of the Indian Limitation Act, 1963
